TERMS & CONDITIONS

CONFIRMATION:
Note that you will not be charged until tentative bookings for activity, adventure or package deal have been made and validated with you by phone or e-mail. Full payment must be made on confirmation of booking. Commencement of activity/adventure participation is subject to payment. O'Brien Guides can cancel booking if payment has not been made by time specified.

RISKS & RESPONSIBILITIES:
All clients, or parents/guardians of clients who are minors, are responsible for any and all medical attention or search & rescue response for any and all injuries that may occur on any activity or adventure. We strongly recommend that clients have existing health and/or travel insurance in place sufficient to cover any and all injury or expense incurred for any and all healthcare or search and rescue fees. Rescue fees are always paid by the client. Participation in any activity or adventure carries with it the risk of injury or death caused by, but not limited to , the following: dehydration, heat stroke, dangerous terrain, vehicular traffic, unforeseen natural & human events etc.

DISCLOSURE:
There are no refunds for cancellations due to misrepresentation of physical abilities and/or existing or previous health conditions. Failure to disclose information of such issues certainly can mean cancellation without refund.

CANCELLATION CONDITIONS:
If you cancel your booking beyond 24 hours of date/time for arranged activity, adventure and/or package deal you will not be entitled to a refund. We reserve the right to cancel activities, adventures and/or packages, vary itineraries - full refund is made payable under those circumstances. There are no refunds for reasons involving personal conduct.

RESTRICTIONS:
Do not consider booking any activity, adventure and/or package deals if you have existing health problems such as severe asthma, obesity, insulin dependant diabetes, epilepsy, past or existing heart disease, recent invasive surgeries and severe allergies. Failure to disclose such information may result in cancellation at any point without refund. Please be honest and upfront about any health related issues that could effect your performance so that you receive the highest standard of safety.

MINORS:
Policy dealing with minors are strictly for safety to insure enjoyment for your child. Children under the age of 18 years must be accompanied by a legal parent or guardian. If waivers and accompanying paper work signed by a legal parent or guardian are not received on day of activity, adventure and/or package deal, we reserve the right to cancel.

LIABILITY:
Except as provided in the provisions of the Australian Trade Practices Act 1974, you will release the operator, agents or representatives as a result of participating in any activity/adventure of any liability for injury, death, damage, monetary loss or loss of property.

PRICES:
Prices are in Australian dollars. Prices may be subject to change. O'Brien Guides will give you reasonable notice of any price change.
